Hello Paula,I would really like to discuss this issue in person or on the phone. At this point if I don't see resolve, I will send this to the Oregon District Attorneys office. I have been selling on Ebay for over 8 years and this busyer NEVER PAID for 19 auctions. HELLO!!! I want all his feedback removed from my account and I want compensated for the cost of all my auctions, and I want this buyer removed for stealing my photos and posting them on his auctions. THIS IS OUTRAGIOUS. No wonder people are Boycotting on May 1. If this matter isn't resolved you can count me in on this strike. This is totally unfair and illegal, in the state of Oregon.

Ms. Raymond and Mr. Stevens - I have heard that messages continue to be sent to the other party directly. Communicating directly with one another may be counter-productive, especially when one of the parties feels harassed by the other, and I would ask that while the mediation is ongoing, that you both refrain from doing so.Paula McCarronST Mediator

Ms. Raymond - I have already received all the email you sent. I do need you to tell me what ideas you have to resolve the problems that you think you BOTH could agree to?Paula McCarronST Mediator

Thank you for the Shout back. I am collecting the information but I do need an email address to forward all of this to. This guy even used one of my photos in the auction that he didn't pay for. What is going on here? I don't understand why ebay can't even read what is going on with your own system. I have saved all the messages in my customer relations file in my messages.Gathering all of this is so much work, again, a headach caused by the buyer who never paid for his items. Please give me contact information to send this information to.

Ms. Raymond - I will let you know when I receive the email. In the meantime, as I mentioned earlier, in order to try and accomplish an agreement, I need to know what ideas you have to resolve the problems that you think you BOTH could agree to?Paula McCarronST Mediator

Thank you for your responce in this matter. I have forwarded the many insulting emails I received from this person and feel the slander and name calling in his feedback is totally uncalled for. Please advise me when you receive the email sent to you moments ago and I am sure you will see how rude and unprofessional all this has been.My confidence in Ebay's resolve is in question at this point, that this person is allowed to do any business as a Seller. I have always held high standards on my business and the affects this has had on my DSR is rediculous as I did everything and more to get this resolved. Please advise,Cynthia Raymondshowcasemerchandise.

Ms. Raymond - It sounds like this has been a difficult transaction, and you both have quite a few complaints about the other. The feedback the buyer left you can not be withdrawn unless the buyer agrees to do that. The feedback you left the buyer can not be withdrawn unless you agree to do that. Given the level of apparent animosity here, I must admit I'm skeptical you two can reach an agreement and if you don't, no one's feedback would be withdrawn. In order to try and accomplish an agreement, however, I need to know what ideas you have to resolve the problems that you think you BOTH could agree to?Paula McCarronST Mediator

There are no other issues to resolve. This buyer wants my pictures database for his future catalog publication and I will not give them to him. I removed the pictures from my site after months of waiting for payment and then after receiving "MANY EXCUSES", See email history. I believed and trusted that his payment would arrive, several times, I even removed the Non Pay Action against him to preserve his MOTHERS account. Well now I am left without a means to regain the money lost for the auctions but the time and effort to retake photos to relist this auction. I own him nothing, right? He purchased the items in the auction, not my photography.I still feel that this person is a detriment to Ebay as a buyer and as a seller, as you could see his spamming efforts on his auctions that were all removed.I have all correspondence from this person and you will see how unreasonable he has been through all this. Negative feedback is for sellers who do not perform, well I feel I went above and beyond to resolve this issue and yet he argues and never paid. My only fault was trusting in his word and holding the items for over 2 months for him to pay.If he wants to resolve this then I should be compensated for all the problems he has caused me in my doing business. As far as any further legal issues, I would like to hear it. Does he want to put me in jail for selling and trying to collect money on Ebay? To remove his feedback would cover up the fraudulent practices of this buyer and it would be a shame to have him around any longer.

Dear Ms. Raymond and Mr. Stevens: My name is Paula McCarron, and I am the SquareTrade Mediator assigned to try to help you resolve the problem concerning an ebay transaction. Thank you both for agreeing to use mediation to try and resolve your disagreement. ** Mediation is a way to resolve problems by agreement. ** I am not a judge and I do not decide the outcome of your case. Any outcome is wholly determined by you. ** As a mediator, I do not find fault with anyone or place any blame. ** I do not give legal advice or represent either party. ** If we reach a point where an agreement cannot be reached, I have two options. * The first option is to suggest a possible solution. I will only make such a suggestion after I have permission from both parties. Whether or not to accept this suggestion will be up to you. * The other option is to close the case. You would then be at the same point you are now. I will be asking you for information to help me understand the situation and to explore possibilties for settlement. In order to help you resolve this as quickly as possible, I ask that you respond to any questions within 48 hours. PLEASE NOTE THAT YOU WILL NOT BE ABLE TO SEE EACH OTHER'S MESSAGES. Thus, I will generally be sharing information between you, but I will not share anything that you ask me to keep confidential. You should also know that if you ask me to recommend a resolution, my recommendation will be based upon the information that I have received from you both. At this point I have read all the information that you both have submitted, and I would appreciate it if you could tell me the following: Mr. Stevens - What issues need to be resolved?Thank you for your cooperation, and I look forward to working with you both.
